2023: The Decision of the Lower Court to Disqualify Rivers APC Candidates Was an Error -Appeal Court Rules

The Appeal Court on Thursday ruled that ordinarily the Federal High Court lacks jurisdiction to entertain such suit and its decision which disqualified candidates of the Appellant is a nullity.

The Judgment is on Appeal No.: CA/PH/5544/2022, All Progressives Congress v. Peoples Democratic Party & Ors

The court ruled that the PDP had no locus standi to institute the action challenging the primary election of the Appellant in the first place. So, Appeal is allowed.

“Judgment of 11th November 2022 is hereby set aside as well as all the Orders made thereon are hereby struck out for lack of jurisdiction.” ~Court ruled

This appeal arose from the judgement in FHC/PH/CS/152/2022. A Suit by the 1st Respondent, Peoples Democratic Party which sought to restrain INEC from recognizing the candidates nominated by the Appellant, (All Progressives Congress.

The Judgment of the trial Court delivered on November 11, 2022 per Justice A. T. Mohammed had disqualified the candidates of the APC for the Rivers State House of Assembly of the Appellant.

Meanwhile the appeal on dual citizenship concerning the Rivers State APC Guber candidate is expected to be heard on Monday, the 9th of January 2023
